Yowzzer Terms of Service and Privacy Policy

By accessing or using the Yowzzer website, mobile application, or any associated services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). Please review them carefully.

Yowzzer does not assume responsibility for the accuracy, legality, or completeness of such content. You agree that the information provided in your listings will be accurate and comply with applicable laws.
Content Ownership: While you retain ownership of any content you submit, by uploading content to the Platform, you grant Yowzzer a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, display, and distribute your content as part of the Platform’s functionality. This license allows Yowzzer to showcase your listings, reviews, and other user-generated content to improve user experience and the overall operation of the Platform.

5. Third-Party Links

The Platform may include links to third-party websites that Yowzzer does not control. Yowzzer is not responsible for the content, privacy policies, or practices of third-party websites. Use these websites at your own risk.

6. Real Estate Transactions

Yowzzer’s Role: Yowzzer facilitates connections between buyers, sellers, and real estate agents but is not a licensed broker or fiduciary. Yowzzer does not provide brokerage services and is not involved in actual property transactions.
Transaction Responsibility: Users are responsible for conducting their own due diligence in all real estate transactions. Yowzzer does not guarantee the accuracy of information on the Platform and assumes no liability for any disputes or issues arising from real estate transactions.

7. Payments and Membership

Subscription Fees: Yowzzer may offer subscription-based services that include additional benefits. Subscription fees are non-refundable unless otherwise specified. Pricing is subject to change with advance notice.
Billing Information: You must provide complete and accurate billing details when subscribing to paid services. Payments are processed through a secure third-party provider, and Yowzzer is not liable for payment processing errors.
Lifetime Rate Guarantee: The first 1,000 agents who subscribe to Yowzzer’s $99 plan will have a lifetime rate lock, provided their subscription remains active. Canceling the subscription forfeits the lifetime rate.

8. Reward Points and Incentives

Earning Reward Points: Both sellers and buyers can earn reward points by engaging in eligible activities such as listing properties, providing feedback, referring new users, and completing transactions with Yowzzer Partner Agents.
Eligible Activities Include:
- Sellers: Listing properties, accepting offers, and closing sales through Yowzzer Partner Agents.
- Buyers: Scheduling property viewings, submitting offers, and completing purchases.
- Agents: Engaging new clients, managing listings, and completing transactions.
Redemption of Points: Reward points are redeemable as credits towards closing costs once the real estate transaction is finalized. Points are non-transferable and may not be exchanged for cash unless specified.
State-Specific Regulations: The availability of reward points may vary depending on state laws regarding real estate rebates and incentives. Users are responsible for ensuring compliance with local regulations before earning or redeeming reward points.

9. Disclaimer of Warranties

As-Is Basis: The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. Yowzzer does not guarantee that the Platform will be free of errors or uninterrupted.
Accuracy of Information: Yowzzer does not guarantee the accuracy or completeness of any content on the Platform, including user-generated content and listings. Users should verify all information independently.

10. Limitation of Liability

Damages: Yowzzer, its affiliates, employees, and agents are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, even if advised of the possibility of such damages.
State-Specific Limitations: Some states do not allow limitations on certain liabilities. In such cases, Yowzzer’s liability will be limited to the maximum extent permitted by law.

Yowzzer reserves the right to suspend or terminate your account and access to the Platform at any time without notice, for any reason, including violations of these Terms or risks posed to Yowzzer or other users.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the state where Yowzzer is headquartered, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration will be conducted in Yowzzer’s home state.

4. Feedback and Suggestions

Yowzzer welcomes feedback, ideas, and suggestions to improve our Platform and services. Any feedback you provide is entirely voluntary.
